The Supreme Court permits distribution of ‘citizenship by descent’

The Supreme Court, on Tuesday, allowed distribution of citizenship by descent to the children of those parents who have obtained their citizenship by birth during the government’s one time-special decision in 2006.

A division bench of Justices Hari Krishna Karki and Bam Kumar Shrestha announced the final verdict of go-ahead after hearing on Tuesday, stating that the constitution provision allows to issue the citizenship by descent to such eligible individuals as long as the criteria meets to get one.

The apex court on April 8 ordered the authorities to halt the distribution of citizenship by descent to such individuals following a writ petition against the Home Ministry filed by senior advocate Balkrishna Neupane.

The Ministry of Home Affairs on April 2 issued a circular to DAOs across the country to grant the citizenship by descent to children whose parents are citizen by birth.
